Terms of Service

1. The service

Topped generates ready-to-post content for your app, many of the posts based on real posts our team picks - shown with the view or like count the platform reported - with pictures from templates our team curates. Topped also watches accounts you choose and surfaces their posts with the counts those platforms reported. With your approval, Topped can publish posts to your connected TikTok, Instagram, and YouTube accounts and report the counts those platforms give back. You can also connect your own AI agent to Topped, and it acts as you (section 4).

2. Accounts

You must provide accurate information to create an account and are responsible for activity under your account and for keeping your sign-in secure. You must be at least 18 years old, or the age of majority in your jurisdiction, to use Topped.

3. Acceptable use

You agree to use Topped only to publish content you have the right to publish, and to:

• comply with the terms of service and content policies of every platform you connect (TikTok, Instagram/Meta, YouTube/Google),
• not use Topped to spam, harass, mislead, or infringe on anyone else’s rights,
• not attempt to circumvent rate limits, quotas, or the platforms’ own rules,
• not re-post other creators’ posts as your own - Topped shows their public posts so you can learn from them, and they belong to their creators,
• not use Topped to buy or fake engagement, warm accounts, or misrepresent performance metrics.

We may suspend or terminate accounts that violate this section or put our platform integrations at risk.

4. AI-generated content

Posts made with Topped are generated or assisted by AI (captions, slide copy, images, and video). Each post starts with TikTok’s and YouTube’s AI-generated label switched on; you can switch it off for a post, and you are responsible for labeling AI content the way each platform requires. You are responsible for reviewing generated content before it publishes and for ensuring it is accurate and appropriate for your app and audience.

Nothing publishes unless you approve it in Topped, or an agent you connected approves it for you. A connected agent acts as you: it can approve, schedule, and post; cancel or move scheduled posts; upload, make, and delete media; edit your Product and Watchlist; disconnect accounts; and spend your credits and content saves - all with no extra step inside Topped. You are responsible for what your connected agents do, and you can revoke them at any time in Settings.

5. Billing

Paid plans are billed through Polar, our merchant of record, monthly or annually, and renew automatically at the end of each period until you cancel. Checkout is a redirect to Polar’s own hosted checkout page, and Polar handles payment collection and tax/VAT compliance for your purchase. An upgrade starts at once and charges the difference for the rest of the period; a move to a cheaper plan starts at your next renewal; switching between monthly and annual billing takes effect at once, prorated. If a renewal payment fails, paid features pause while Polar retries; if it never goes through, the plan ends and your account moves to the free tier. Refunds are handled as described in our Refund Policy and Polar’s buyer terms.

Each plan includes two monthly allowances, both shown on the pricing page and in the app. Credits are the single meter covering every AI generation (images and video, any model), with the exact credit price shown on every button before you click it. Plan credits don’t carry over: a monthly plan’s credits reset on your billing date, and an annual plan’s on the 1st of each month. The free tier starts with a one-time grant of credits instead.

Content saves are a separate allowance, spent once when you approve a post - whether you schedule it, post it now, or save it to your Library. Plan saves reset on the 1st of each month and don’t carry over. Posting a saved post again, rescheduling it, adding accounts, or editing its words or layout costs nothing more; an edit that adds new pictures, video, or sound saves it as a new post and uses one content save.

If you run out, you can wait for the reset, upgrade your plan, or buy an optional one-off top-up at a flat price: credits on any plan, content saves on paid plans. Top-ups never expire. Topped never charges you automatically for individual generations - you never spend beyond your allowances unless you explicitly buy a top-up.

6. Cancellation and downgrade

You can cancel a paid plan at any time from your account settings. It stays active until the end of the period you paid for; then your account moves to the free tier rather than being deleted, so your history and Scoreboard are preserved and you are never locked out of your own data. You can export everything Topped holds about you - your Product, posts, media, Scoreboard history, and more - at any time; see the Privacy Policy for how export works and how you can delete your account yourself. Deleting your account ends any paid plan at once, with no refund for the time left.

7. Ownership

As between you and Topped, you own the content you provide and the posts Topped makes for your account. The post templates, stock photos, Topped’s own sounds, and other material we supply remain ours or our licensors’; we license you to use them in the posts you make with Topped, including after you leave. Laws on who owns AI-generated material differ by country, so we can’t promise it is protected by copyright everywhere.

You give us permission to store and process your content only to run Topped for you. We do not use your app’s content to train models or to promote other customers.

If you believe something on Topped infringes your rights, email support@topped.ai with a link to it, and we will review it and remove it where appropriate.

8. Disclaimers and liability

Topped is provided “as is.” We do not guarantee any level of views, engagement, downloads, or install attribution - the App Store does not provide per-post install data, and any figures Topped shows are engagement counts the platforms reported, not a promise of results. Topped depends on TikTok, Instagram, and YouTube, which can change or limit what apps may do; we are not responsible for their decisions about your accounts. To the maximum extent permitted by law, Topped’s liability for any claim arising from your use of the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules. Nothing in these terms removes any mandatory consumer-protection rights you have under the laws of the country where you live. If any part of these terms is found unenforceable, the rest remains in effect.

10. Changes to these terms

We may update these terms as Topped changes. Material changes will be posted here with an updated date, and where required we will notify you by email before they take effect.
